--"If" we had smarter jurors, murderers wouldn't be set free.
Well, free, at least, to serve his life term from the FIRST murder conviction!

Hernandez Found Not Guilty

Hernandez is already serving a life sentence due to his conviction in another murder trial. In 2015 Hernandez was found guilty of the 2013 shooting of Odin Lloyd.

....I remember when Jose Baez was just a jail house lawyer hanging around the county jails in central florida looking for clients, and then he ran into Casey Anthony.  His successful acquittle in that case and now this, will add to his fame.

I remember the first time I made it through the entire "Jury Duty" process.  Actually got into the courtroom and went through rounds of questioning from the attorneys.  The case was breaking and entering, rape, and sodomy.  The state basically tried to select jurors that had at least a high school education or better.  Didn't work, the defense rejected them, rejected gun owners too, and rejected veterans.  The judge upheld all the rejections but one, he over ruled on a young lady that was in college, planning on being a lawyer, and her daddy was judge.  Go figure.  The rest of the jury had less than a high school education.  I left the courthouse feeling like the process is a sham.

Next time just check the box that says you want tort reform. I was out the first round.

How can you say "sham"?  Each lawyer gets an equal number of rejections and sometimes the Judge rules a person out that does not count against the lawyer.  Both sides play the same game to eliminate certain people. It is totally fair.

If this were Hernandez's first trial, I feel sure he would have been found Guilty.  The prosecution did not work late hours trying to prove its case.  The guy will be in jail many moon's.

I say sham because they are geared towards dumbed down juries.  Everyone accepted by the prosecution was rejected by the Defense.  The judge only over ruled for his friends daughter, the rest of the rejections were upheld.  To me, that's sham, because they were rejected because of higher education and obviously better critical thinking skills.

That is the attorneys choice. But it can't go on forever. There are challenges for cause and 3 preemptory challenges. That isn't a lot of way to influence the jury if they were reasonable. Some how in larger society doing Jury duty and doing it right has become something that people don't want to do. I wonder who is responsible for that?

But I have also been struck from Jury duty. I don't know why. Perhaps my status as a lawyer and working in the court. But, it makes me angry.  I did jury duty once when I was in college and there was one person who thought it was guilty until proven innocent.

IMHO the jurors are simply stupid mostly. I happen to be the person who deals with the jury at my courthouse... I get the verdict first because someone has to make sure they can follow directions before we read it in court (which I do).  Mostly they can't. One jury we had a guy that refused to vote with everyone else because "he wasn't going to do nothin against a cop." Then why was he there?

Some just want free food and last high profile jury literally complained about their free food and waned "organic" foods.

But on this one... I don't think the Commonwealth had the evidence. They were relying on a POS as the main witness against Hernandez. And that was pretty much it. If the jury found that guy not to be credit worthy well...

In my opinion, dumbed down juries are easier for a slick talking attorney to sway.  That's why the defense will reject people that have more education, gun owners, conservatives, etc.  If slick talk with slow minds can change the outcome, then justice isn't blind.
